1. Payment. All consumer sales through this website are final. Payment by credit card is due at time of purchase, using the online order system and electronic shopping cart for checkout.
2. Sales Tax. State sales tax is added to California resident orders.
3. Returns. Except for a defective product, there are no returns, exchanges or refunds. A returned defective product will be replaced with the similar product. No goods shall be returned for replacement without first obtaining a Return Authorization Number (RA) from Perlop Cosmetics.
4. Warranty. Perlop Cosmetics warrants that the goods supplied under this invoice (the “goods”) shall conform to the description stated on the invoice. The foregoing warranty is Perlop Cosmetics’ sole warranty with respect to these goods. All other warranties, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose, are hereby disclaimed. Perlop Cosmetics liability for breach of warranty hereunder is limited solely to the replacement of the defective goods, which shall be returned to Perlop Cosmetics plant, transportation charges prepaid by buyer; and the failure to give notice of a warranty claim within thirty (30) days from date of delivery shall constitute a waiver by buyer of all claims in respect to such goods. The foregoing shall constitute the sole remedy of buyer and the sole liability of Perlop Cosmetic under this warranty.
5. Limitation of Liability. Perlop Cosmetics liability to buyer, whether in contract, in tort, under any warranty, in negligence or otherwise, shall not exceed in any case the return of the amount of the purchase price paid by buyer and under no circumstances shall Perlop Cosmetics be liable for special, in direct or consequential damages.
6. Shipment. Standard ground shipping and handling charges apply to all orders, which must be within the Continental US. Free shipping on all orders over $15.
7. Governing Law. The parties agree that the validity, interpretation and performance of any agreement arising out of this transaction shall be governed by the laws of the State of California without regard to conflicts of interest laws. Buyer and Perlop Cosmetics hereby submit to the exclusive jurisdiction for the resolution of any disputes hereunder, to Superior Court in Los Angeles County or United States District Court in Los Angeles County, California. These courts shall be the sole and exclusive places for jurisdiction and venue for the purpose of adjudication of any rights and liabilities hereunder.

This Privacy Policy statement applies to www.conchanacar.com (“Website”) and Perlop Cosmetics, Inc.,a California corporation (“PCI”), (Website and PCI collectively referred to as “Perlop”) and governs data collection and usage. In order to better provide you with products and services offered on the Website, Perlop may collect personally identifiable information, such as, but not limited to:

Agreement between User and www.conchanacar.com
Welcome to www.conchanacar.com. The www.conchanacar.com website (the "Site") is comprised of various web pages operated by Perlop Cosmetics, Inc. ("Perlop"). www.conchanacar.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of www.conchanacar.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.
www.conchanacar.com is an E-Commerce Site.
The purpose of the Site is to promote and sell Perlop beauty products. Perlop sells a line of beauty creams, which include day creams, night creams, cleansing creams, and a brightening mask and may include additional products.

Your use of www.conchanacar.com is subject to Perlop's Privacy Policy, which is incorporated by reference herein. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

Returns and Exchanges are only allowed on UNOPENED products purchased through the Site, and within 30 days of the original purchase date for items sent in error or that arrived damaged only. Refunds that are approved are issued for original purchase price, less original shipping costs incurred by Perlop.

Indemnification
You agree to indemnify, defend and hold harmless Perlop, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Perlop reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Perlop in asserting any available defenses.
Arbitration
In the event a dispute \arising out of or concerning these Terms and Conditions cannot be resolved, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to California law, conducted by a single neutral arbitrator with more than ten (10) years experience in the subject matter thereof, and administered by JAMS, Judicate West, or J.D.R., Inc. (Judicial Dispute Resolution). The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction; provided, however, that any award shall be limited to actual damages and shall not include any consequential, exemplary, or punitive or similar damages. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees.
Class Action Waiver
Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Perlop agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PERLOP AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF PERLOP COSMETICS, INC. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.
Termination/Access Restriction
Perlop reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of California. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms and Conditions, including, without limitation, this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Perlop as a result of this agreement or use of the Site. Perlop's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Perlop's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Perlop with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between Perlop the user and Perlop with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between Perlop the user and Perlop with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
Changes to Terms
Perlop reserves the right, in its sole discretion, to change the Terms under which www.conchanacar.com is offered. The most current version of the Terms will supersede all previous versions. Perlop encourages you to periodically review the Terms to stay informed of our updates.
